Webmistress Day Campaign: Official Rules

The Campaign

You understand that by participating in the Webmistress Day Campaign ("Campaign") you are accepting the terms of these Campaign Official Rules (“Official Rules”) and agreeing to be bound by them. The "Sponsor" of the Campaign is ManageEngine, a division of Zoho ("ManageEngine"). The Campaign ends at 23:59 hours PST on the 27th of August 2019.

Eligibility

The Campaign is open to legal residents of all countries except Cuba, Iran, North Korea, Sudan and Syria. The Campaign is subject to the applicable laws. Employees ( including their friends and family members), resellers, and partners of Zoho are not eligible to participate in the Campaign. In the event that ManageEngine requires any assistance in order to assess your compliance, you must promptly provide such assistance. ManageEngine reserves the right, at its sole discretion, to disqualify your entry if it concludes that: a) you have tampered with the entry process or the operation of the Campaign or, b) have acted in violation of these Official Rules or any such other applicable state, federal, or local laws or regulations or, c) you do not provide the requested assistance for compliance in a timely manner. The decisions of ManageEngine shall be final and binding in all respects and you agree to be bound by the same.

Selection and Prize

Participants who take part in the Campaign, send out an e-card and tag a web developer, web designer, web administrator or a web marketer ("Webmistress") with a small message about the Webmistress, will stand a chance to win one of the 3 Amzon gift vouchers worth US$25 ('prize'). Based on the entries, the winner of the prize will be selected by ManageEngine. A participant will not be eligible to win more than one prize. Manner of selection of the winners for the Campaign and the applicable prize(s) will be mentioned in the Campaign webpage. Prize(s) are not transferable, assignable or refundable and cannot be substituted for cash. Prize(s) must be accepted as awarded. ManageEngine reserves the right to offer an alternate prize of equal or greater value if for any reason any prize cannot be awarded as contemplated by ManageEngine.

Winner Notification

The prize winners will be notified via an e-mail and also through an announcement on the ManageEngine’s Facebook, LinkedIn and Twitter pages within a period of three days from the date on which the Campaign ends ("Winner Notice"). The Winner Notice will include information on how the winners can claim their prizes. Failure to respond to the Winner Notice within 7 days from the date of Winner Notice or failure to comply with any rule, regulation or limitation will result in the forfeiture of the prize. In order to receive a prize, the winner may be required to sign an affidavit of eligibility, liability and publicity release (unless prohibited by law). 

Content of the Posts

The post made, as part of taking part in the Campaign, should not:

• be unlawful, in violation of any law, or violate the IP rights of any third party;
• be hateful, tortuous, slanderous, or libellous;
• promote bigotry, racism, sexism, hatred, or harm against any group or individual, nor should it promote discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age;
• contain any personal information, such as personal names or e-mail addresses;
• promote alcohol, illegal drugs, tobacco, firearms, or weapons (or the use of any of the foregoing);
• promote any activities that may appear unsafe or dangerous;
• contain any nudity or sexually explicit, lewd, offensive, disparaging, or otherwise inappropriate content;
• communicate messages or images inconsistent with the positive images and/or goodwill with which Zoho or participants wish to associate.

Limitations of Liability

By taking part in the Campaign, you agree to release Zoho and its respective affiliates, subsidiaries, and their respective employees, agents, and representatives (collectively, "Entities") from any and all liability, claims, or actions of any kind whatsoever for injuries, damages, or losses to person or property that may be sustained in connection with the receipt, ownership, or use of the prize or with participation in the Campaign. By taking part in the Campaign, you agree that no claim relating to such injuries, damages, or losses shall be asserted against any of the Entities.

Contact Information

Contact information that you submit will be used only in connection with the Campaign and not in any other manner. 

Rights of Publicity 

Provided the winner has permitted ManageEngine to use the winner’s name, biographical information and any statement the winner makes in connection with the Campaign or about ManageEngine, each prize winner grants to ManageEngine the right to print, publish, broadcast and use worldwide in any media now known or hereafter developed the winner’s name, biographical information and any statement the winner makes in connection with the Campaign or about ManageEngine for advertising and promotional purposes, in connection with the Campaign, without additional consideration.

Privacy

Any Contact information or content posted on social media platforms in connection with this Campaign shall be processed in accordance with their respective privacy policies. ManageEngine is in no way responsible for their privacy practices. 

ManageEngine in no way has control over the preview options of the posts made. Any content that you may post shall be in accordance with your privacy settings in the applicable social media platform.

ManageEngine is not responsible or liable when a third party is tagged or mentioned in a post as a part of this Campaign in any social media platform. 

General Conditions

The Campaign will be governed, construed and interpreted under the laws of India. ManageEngine reserves the right to make changes in the rules of the Campaign, including the substitution of a prize, which will become effective upon announcement. If for any reason the Campaignis not capable of being conducted as described in these Official Rules, ManageEngine shall have the right, at its sole discretion, to cancel, terminate, modify or suspend the Campaign.
